Tower Will Be Nightmare for New Jersey Neighborhoods

Who knew a tower could be so scary? The residents of the West Deptford Township in New Jersey believe that the potential location for a T-Mobile tower will be a nightmare for three neighborhoods. David Sileo filed a lawsuit against the carrier in 2010 to contest the proposed location one month after the zoning board approved the variance for the 156-foot tower. The tower would be located a few hundred feet from his home and since the filing of that lawsuit, there has been a long, drawn-out legal battle regarding the tower. In April 2011, Judge Richard S. Hoffman nullified the previous variance, and sent the issue back to the zoning board, which then denied T-Mobile’s request. Following this, T-Mobile challenged the board’s decision in Superior Court, where Judge Anne McDonnel ruled in favor of T-Mobile. Sileo’s lawsuit was also dismissed at the time. The zoning board then denied T-Mobile site plan approval on two more occasions, in June 2012 and January 2013. Following these denials, T-Mobile filed a lawsuit in Superior Court, and again Judge McDonnell ruled in favor of the company. This is fun, right? The zoning board decided to take their case to the Appellate level but still lost during August 2014. Now that the town has accepted that their “nightmare” will be coming true, they are hoping to at least find a different location than the previous one proposed.
