Lewiston Officials File Suit

The officials in Lewiston, New York, have filed a lawsuit against Niagara County over construction of a cell tower that continued despite alleged many stop-work orders. This tower is part of the $10 million, federally mandated project to consolidate first responder’s communication systems across the county. The town attorneys filed the complaint on November 24 in State Supreme Court and named Niagara County, Upper Mountain Fire Company, consulting firm L.R. Kimball, and Motorola Solutions as defendants, according to the Niagara-Gazette. “Defendants in this action were charged with constructing a series of towers to … protect the residents of Niagara County,” the complaint states. “Unfortunately, in constructing a tower in the Town of Lewiston, they did the opposite.” (Niagara-Gazette) The 220-foot tower was constructed in late July and the court document alleges that this construction violated multiple stop-work orders. The town maintains that they were not aware of this towers construction and that no attempt was made by the county to adhere to the town’s tower regulations.
