The FCC finalized a deal Friday with NE Colorado Cellular, Inc. doing business as Viaero Wireless, in Kersey, CO. The Enforcement Bureau signed a Consent Decree to resolve its investigation into whether the carrier operated an unregistered base station without authorization in the 3650-3700 MHz band.
Because this band operates on a shared basis, knowledge of the location of the registered emitters is essential for frequency coordination, according to the agency. Unregistered stations can undermine successful coordination and cause harmful interference to other licensed stations.
To end the investigation, Viaero admits that it operated an unregistered base station without authorization and will pay a $16,000 civil penalty. The company also agreed to implement a compliance plan to ensure such violations do not occur in the future. In exchange, the Commission drops the case.
