Diamond Communications and the Village of Waukesha, WI have been tentative in forming a relationship, according to GMToday, but signs are favorable that they will work things out. A settlement between the parties would result in a new cell tower near Glendale Road and Highway 164. The structure would be the second tower in the area, following the recent completion of a tower at nearby Infinity Field.
When the matter came up for a vote in December, Trustees say they were surprised when the decision was a 2-to-2 tie. Diamond followed the decision by filing a lawsuit alleging that no “substantial evidence” was presented to support a denial. The tower developer further noted that since no firm decision was reached within the state’s 90 day allowable window, the Conditional Use Permit should be deemed approved.
Currently being discussed are the terms required for Diamond to continue with the monopole construction that could eventually see up to four carriers. The Village Board has asked for assurances that a “block exterior” wall be no higher than 15-feet and enclose the tower and its equipment. Both parties are to accept responsibility for their own legal fees in this matter, if the CUP is issued in a timely manner.
The matter will come up for its next vote before the Village Board within the next few weeks. If the Board grants the permit, Diamond Communications has said it will drop the lawsuit, reported GMToday.
