Peppertree Capital Story Draws Response

A story that ran last Thursday in Inside Towers, Peppertree and Other Investors Win $354 Million in Arbitration Against Terra Towers elicited a response from Terra Towers yesterday saying their company is unable to directly address “the inaccuracies and false claims being communicated by Peppertree.” The response came from a public relations agency, Media Theory, who sent the letter on behalf of Terra Towers.

The letter stated: “As has been reported on public record, throughout the dispute there have already been a long series of criminal investigations, some of which have resulted in indictments and arrest warrants issued against several individuals in several jurisdictions. Interpol was requested to detain these individuals, including Mr. Jorge Gaitan Castro, a former executive in Continental Towers. Following his arrest at the request of the authorities of El Salvador, the courts in Guatemala are currently going through the extradition process, and there is also a separate arrest order from Guatemalan courts for other criminal investigations.”

The letter stated “attempts by parties to portray the detention of Mr. Gaitan as a civil matter are misleading and factually incorrect” when, in point of fact, neither he nor a Mr. Castro were mentioned in the Inside Towers story. 

A closer look at documents issued by the ruling Tribunal in the case said there was ‘a multi-faceted effort by [Terra/Mr. Hernandez] to present…a false narrative of misconduct and criminality by Mr. Gaitán. This effort included, as its most central feature, filing multiple criminal complaints in a court in Guatemala. Those criminal filings relied on a false account of submissions made in this arbitration and a false description of the events.”

The public relations agency concluded by saying Terra Towers remained committed to upholding and complying with its legal obligations concerning the matter referenced by Peppertree in their press release and to abiding to all its legal obligations related to this dispute.
