Suit and Countersuit With Verizon Rages On in Pittsfield

UPDATE For those keeping score cards, Alma Street residents in the town of Pittsfield, MA have made a move, filing a lawsuit against their city for failing to enforce a cease- and-desist order against Verizon, the owner and operator of the tower, according to SpectrumNews1.com

Attorney Scott McCollough stated that the intent of the lawsuit is to put the matter in the hands of an independent council. The plaintiffs contend that Mayor Linda Tyer and City Solicitor Stephen Pagnotta used political pressure to stop the Board of Health from acting on last spring’s cease-and-desist order. The recent legal action would ensure, “Proper resources, primarily inside counsel, someone who can tell the board what its legal rights, duties and obligations are that are not conflicted,” said McCollough, “And they can find a solution at the board level to this problem.” 

The opponents who complained about the cell tower before it was built are, coincidentally, the same ones now claiming to suffer from health issues caused by the proximity of the tower, reports SpectrumNews1.com. Prior evidence gathered by the residents has failed to provide a direct link between the reported maladies and the cell tower, but the group of residents has continued to pressure the Board of Health to keep digging.

“The board has been working really hard to try to find a solution to the problem it knows exists, but it has been frustrated by outside interference,” noted McCollough.

Verizon has maintained that it has adhered to FCC guidelines and that the cell tower does not represent a health risk. The findings of the World Health Organization have also determined that cell towers are not a radiation threat.
