UPDATE After receiving a denial of their tower project from the town of Thornton, NH, cell tower developer, Vertex, claims that the action was unlawful and seeks to settle the matter in court. As NHPR.org reports, Vertex contends the town is in violation of federal mandates. In addition, the plaintiff states that they were not given an opportunity to address concerns about potential fire and water run-off hazards that were the basis for the town’s decision to disallow construction of a cell tower at that site.
As reported by Inside Towers in April, although locals conceded that wireless service in the remote Waterville Valley Ski Area was scanty, concerns about aesthetics along the hiking trails through the White Mountain National Forest, had other residents up in arms.
The Waterville Ski Resort is owned by members of the prominent Sununu family, who have declined public comment on the cell tower project.
In addition to the lawsuit filed by Vertex, a second suit has been filed at the state level by residents opposing the construction of the White Mountain cell tower. This lawsuit is asking the State Superior Court to rule that a variance never should have been granted to Vertex.
