UPDATE An area that needs a cell tower still doesn’t have one; the latest obstacle is a lawsuit disallowing construction at the selected site, reports NorthJersey.com. The cell tower issue has lain fallow since last year, when Howard Waldrop announced his mayoral candidacy and pro-cell tower platform. Waldrop lost his bid for mayor.
Over the years, different potential sites have been under consideration to host a cell tower site, with the best option reasoned to be a location near the Fire Company 3 station. However, residents of nearby Aspen Court have engaged a lawyer to argue that the Rozanski Lane easement on their property is off limits for the project. As the only road to and from the fire station, use of the Rozanski Lane access point is a necessity.
Members of the volunteer Mahwah Cell Tower Task Force were quick to challenge the township on the latest delay. “We recently learned the lawsuit filed by residents adjacent to Firehouse #3 seeking injunction against using the existing easement to upgrade electrical service to the site, and further indicating that needed waivers have not been secured from DEP to construct the facility,” the written notice began. “Please comment as to the Township’s intended actions in regards to this suit.”
The dead spot in Mahwah remains dead sixteen years after it was first identified. Consultant Declan O’Scanlon of FSD Enterprises has indicated that a temporary cell tower is in the works, but given the volatile history of this project and the latest lawsuit, the tower’s future remains uncertain.
