The FCC waived its auction rules and okayed a request from T-Mobile to allow a joint bidding request. T-Mobile needed the waiver because of its plans to acquire Sprint. More than a year after the transaction was announced, the FCC released the application and bidding procedures for the upcoming auction of Microwave Flexible Use Service in the Upper 37 GHz, 39 GHz, and 47 GHz Bands. Bidding for Auction 103 is slated to start December 10.
The agency said in its decision unique circumstances applied in this case. The FCC previously granted T-Mobile’s similar request for Auction 102, and the Commission believes it’s still in the public interest to grant T-Mobile’s current request so the carrier may certify and submit a short-form application to participate in Auction 103. Denying the request, the agency believes, would be “inequitable and contrary to the public interest.”
